1. Completing an application for membership ('Membership') in the Palmers Rewards Programme ('Rewards Programme') and/ or receipt and use of a Palmers Reward Card ('Card') is deemed acceptance by you of these Terms and Conditions ('Terms'), as amended by Palmers from time to time.
  2. Applications for Membership may be completed in store or online. Failure to provide any information designated as 'mandatory' will mean you will be ineligible for Membership. All information provided by you must be true and correct. You agree to keep your details up to date at all times by advising any changes by advising a staff member in store.
  3. Applications may be made by any individual who is resident in New Zealand. Only one Membership is permitted per individual. Palmers reserves the right to accept or reject any application and shall not be required to provide any reason for such acceptance or rejection.
  4. Membership is free. Memberships are available for individuals only, not organisations or groups. Your Card is not transferable and can only be used by the person whose name corresponds with the member profile.
  5. Whenever you purchase product/s from participating Palmers stores, you will collect points ('Points') for every dollar spent. The standard rate of points collection is 1 Point for every dollar spent on eligible purchases.
  6. Points will be accumulated and stored on your Card. For every 100 Points accumulated you will receive $10 in rewards ('Rewards'). Rewards will be credited directly to your Card the following working day. Rewards are credited to your Card in denominations of $10 and can only be redeemed in full $10 increments. Points and Rewards cannot be sold, and cannot be transferred to another person unless specifically permitted by Palmers.
  7. Points will expire 52 weeks after the date on which they were received if you have not collected sufficient Points to convert into Rewards. Unredeemed Palmers Rewards vouchers will expire 12 weeks after the date on which they were credited to your Card.
  8. The Rewards Programme is available at the following participating stores: Palmers Albany, Palmers Hamilton, Palmers St James, Palmers Bethlehem, Palmers Welcome Bay, Palmers Plimmerton, Palmers Whangarei, Palmers Pakuranga, Palmers New Plymouth, Palmers Miramar, Palmers Remuera and Palmers Rotorua. Points can only be earned at the participating stores, and Rewards redeemed only at participating Palmers stores. Purchases at stores not participating in the Rewards Programme will not earn Points. Participating stores may change from time to time.
  9. You should present your Card on all purchases of Palmers products. This is to enable Palmers to provide you with full benefits from the Rewards Programme.
  10. Points do not have any value until they are converted into Rewards, and cannot be redeemed for cash, gift cards or any Palmers products. To redeem Rewards you must purchase Palmers products in which your Rewards may be redeemed in a single transaction, the purchase price of which is greater than, or equal to the value of the Rewards you are redeeming. Where the purchase price in a single transaction is less than the value of the Rewards you wish to redeem no change will be given. Where the purchase price exceeds the value of Rewards on your Card, you must pay the difference. Palmers Rewards vouchers cannot be exchanged for cash or gift cards.
  11. Points cannot be retrospectively allocated once a purchase is complete.
  12. Points will be earned on the redemption of gift cards, not the purchase of gift cards. Palmers Rewards cannot be used to purchase a gift card.
  13. Currently you are not able to earn rewards points on online purchases or redeem any rewards you have collected as part of the Palmers Rewards Programme to go towards your online purchases. This option may be available in the future and we will notify you if/when this happens and inform you of any further terms that will apply.
  14. When a Reward is redeemed, Points will not be earned on the value of the Rewards redeemed.
  15. If, in accordance with Palmers' return/exchange policy, you return a product on which you have earned Points, the Points may be deducted from your Points balance, and any Rewards earned with those Points, will be cancelled. If you have already redeemed the reward the Points will be deducted from your account which may mean your account has a negative balance. Palmers reserves the right to deduct Points awarded in error. 

  16. If a refund is requested, any rewards vouchers or discounts applied to the original purchase will be subtracted from the refunded amount.
  17. The Card is not a debit or a credit card. All Cards remain the property of Palmers at all times and must be surrendered on demand.
  18. In the event that your Card is lost, stolen or damaged, you will need to request a new Card either in store or on the Website. You must advise Palmers as soon as you are aware your Card is lost, stolen or damaged. Palmers do not accept any responsibility for lost, stolen or damaged cards or any resulting loss or theft of Points or Rewards.
  19. You can earn Points whether you have your Card with you or not, however you must identify yourself as a Palmers Rewards Programme Member before the transaction is completed. To redeem rewards you can present your Rewards Card or identify yourself as a Rewards member at the time of payment. You may be asked to confirm your Member details to verify your Membership. Your Card may only be used for transactions made by you personally. Palmers reserve the right to require identification when collecting Points, redeeming Rewards, or otherwise using your Card.
  20. If you join the Palmers Rewards Programme online you will not be sent out a Palmers Rewards card. Palmers Rewards cards can be issued at any participating Palmers branch to your existing Palmers Rewards account.
  21. These Terms, including (without limitation) how Points and Rewards may be accumulated and/or redeemed may be amended by Palmers at any time without notice to you. Without limiting the foregoing, Palmers may add or remove products and/or product categories eligible for the collection of Points and Rewards, offer bonus Points or alter the level of spend required to accumulate Points and/or Rewards, whether temporarily or permanently, at its sole discretion. Current Terms can be viewed on the Website, so it is recommended that you check these periodically. Continuing to use your Card after changes to the Terms are made is deemed acceptance of those changes.
  22. From time to time Palmers may provide you with additional offers or promotions in connection with the Card ('Promotions'). These Terms shall apply to such Promotions in addition to any specific terms accompanying such Promotions. In the event of any inconsistency, the specific terms of the Promotion shall apply.
  23. The Rewards Programme may be terminated or suspended at any time without notice to you. In the event the Rewards Programme is terminated or suspended, Palmers reserves the right to cancel or put on hold all Points accrued by you. However, any Rewards that have been credited to your Card prior to the date of termination or suspension will continue to be valid for the lesser of the period of 12 weeks after the date they were credited to your Card and any other period notified by Palmers at the time of termination or suspension.
  24. Palmers may revoke your Membership at any time without notice and for any reason (including but not limited to fraudulent use of the Card or behaviour which, in the view of Palmers, is not acceptable). In the event your Membership is revoked, all accrued Points and Rewards will expire from the date of revocation and you will have no further entitlement in respect of the Rewards Programme.
  25. Except for any liability that cannot be excluded by law, Palmers (including its officers, employees and agents) excludes all liability (including negligence) for loss or damage; whether direct, indirect, special or consequential, arising in any way out of the Rewards Programme or any Membership, including but not limited to, where arising out of:
  26. any technical difficulties, network failures, virus or equipment malfunction (whether or not under Palmers' control);
  27. any loss, theft, unauthorised access or third party interference with or of Points, Rewards, or the Card;
  28. any Points or Rewards that are not properly recorded against a member's Card;
  29. participation in, or termination of, the Rewards Programme;
  30. any delay in replacing a card.
    1. Each exclusion or limitation of liability in these Terms also applies to each of the participating stores.
    2. Your personal information is collected by Palmers and participating stores to enable Palmers to provide you with the benefits of the Rewards Programme. If you do not provide the requested personal information you will be ineligible for Membership. All personal information provided by you will be held by Palmers, in accordance with its obligations under the Privacy Act 2020 and Palmers' Privacy Policy. Palmers' Privacy Policy is available on the Website. Most of the personal information we collect about you is provided by you directly during your interactions with us within our stores or via our website, www.palmers.co.nz, including when you become a member of our Palmers Rewards programme, when you create an account via our website and/or when you place an order for any of our products online. We always take care to ensure that we only collect personal information needed to provide our services and help run our business.
    3. Palmers and participating stores collect your personal information for the purposes of administering the Rewards Programme and such information may be used by Palmers, participating stores and Palmers' related companies and associated agencies for promoting other goods and services of Palmers and its related companies. Palmers may provide transactional data to third parties, but will not provide personal information to third parties other than for the purposes of the Rewards Programme. You have the right to access, update or correct your personal information, or terminate your Membership by contacting Palmers using the contact details below.
    4. You will receive email communications from us upon signing up to the Palmers Rewards Programme. These email communications occur every one to two weeks and include promotional offers, gardening content and giveaways. You will also receive information regarding your Palmers Rewards balance. You may opt out of receiving promotional communications from Palmers at any time via the unsubscribe link on email communications. You can also update your preferences to choose which email communications you would like to receive from us. If you have opted out of all email communications from us, we may need to email you should there be significant or important changes to the Palmers Rewards Programme.
    5. By providing your phone number and consenting to receive text messages from Palmers, you agree to the following terms and conditions:
